Terms of Service

Compute & Storage

Effective Date: July 1, 2026

This Acceptable Use Policy ("AUP") governs your use of DataDack Cloud compute, networking, and storage resources — including virtual machines, VPCs, static IPs, block storage, and the cloud shell. It applies to you and to anyone who uses resources under your account. Violation of this AUP may result in suspension or termination under the Terms of Service.

1. Prohibited Content and Activities

You may not use DataDack Cloud resources to store, transmit, host, or facilitate:

  • Illegal content or activity under any applicable law.
  • Malware, ransomware, botnets, command-and-control infrastructure, or exploit kits.
  • Child sexual abuse material or content that exploits or endangers minors.
  • Content that infringes intellectual property or misappropriates trade secrets.
  • Fraud, phishing, spoofing, or deceptive practices.

2. Network Abuse

You may not:

  • Send unsolicited bulk email (spam) or operate open mail relays.
  • Conduct denial-of-service (DoS/DDoS) attacks, or participate in amplification or reflection attacks.
  • Perform unauthorized port scanning, penetration testing, or vulnerability scanning of systems you do not own or lack written authorization to test.
  • Spoof IP or MAC addresses, or otherwise interfere with other tenants' network traffic.

3. Security and Integrity

You may not:

  • Attempt to gain unauthorized access to the platform, other accounts, the hypervisor, or the underlying infrastructure.
  • Circumvent account quotas, metering, isolation boundaries, or billing controls.
  • Interfere with or degrade the service, other tenants' resources, or the availability zone.

4. Resource-Intensive and Abusive Workloads

  • Cryptocurrency mining is permitted only on plans and regions where it is expressly allowed and must not violate quotas or degrade shared capacity.
  • You must not run workloads designed to abuse trial credits, evade billing, or exhaust shared resources.
  • Automated provisioning must respect API rate limits and account quotas.

5. Shared Responsibility

You are responsible for securing everything you run on your resources — operating systems, applications, firewall and security-group rules, credentials, and data. Keep software patched and follow the principle of least privilege for IAM users, roles, and API keys.

6. Lawful Use and Export

You must comply with all applicable laws, including data protection, export control, and sanctions regulations, when using the Services.

7. Enforcement

We may investigate suspected violations and may suspend, throttle, or terminate offending resources — with or without notice where necessary to protect the platform or other users. Where feasible, we will notify you and provide an opportunity to remediate.

8. Reporting Abuse

To report a suspected violation of this AUP, contact us at abuse@datadack.com. Please include relevant IP addresses, timestamps (with time zone), and log excerpts.
